Why this matters more right now

In FY2025, the EEOC recovered $660 million for workers who reported employment discrimination. Over $528 million of that came through pre-litigation enforcement, the highest recovery in the agency’s 60-year history.

Charge filings are up. The agency received over 91,000 new discrimination charges last year, a 3.4% increase over the prior year.

And the EEOC is resolving more cases faster, which means that employers are getting pulled into the process sooner and with less time to prepare.

What you can actually do

If you run a small team, these are the things that make the biggest difference:

• Train your managers on early, honest conversations. This is where problems either get resolved or get worse.

• Build regular one-on-ones into the rhythm of the business. Frequent, short check-ins where people can raise things before they build up.

• Create a simple informal route for concerns. If something is bothering an employee, they should know exactly how to raise it without it feeling like a formal complaint.

• Act on what you hear. You’ll build trust with your employees if you take action when they give you feedback.

• Document conversations and agreed actions. If something does escalate later, your records are your defense.
